Given the sensitive nature of our dogs needs in care, as they transition, it's imperative that a BEDR representative ensures a safe and appropriate living environment. This must be achieved via an in-person or virtual home visit completed by one of our team members.
Thank you for your interest in fostering for Bright Eyes Dog Rescue, without a home visit agreement you will not be able to move forward with this process.
You will need to have your Guardian Sign this contract and waiver as well.
You will need to have your Landlord/Property Management Company complete an approval form. Details will be linked in your confirmation email once you have submitted this form.
I desire to provide foster services for Bright Eyes Dog Rescue (the “Rescue”) and engage in activities related to serving as a volunteer. In exchange for being allowed to volunteer for the Rescue, I hereby agree to abide by the following policies during the time I am volunteering for the Rescue:
1. I understand it is my decision to volunteer for the Rescue and I will not hold the Rescue,
nor any of its members (including without limitation, employees, officers, and directors),
successors, and assigns liable for any and all liability, claims, causes of action, costs,
damage, injury, or harm caused, arising from, relating to, or which may, or may at any
time hereafter, be attributable, directly or indirectly, to my participation in volunteer
activities with the Rescue. I understand I am responsible for my own insurance coverage
in the event of personal injury or illness as a result of volunteering for the Rescue.
2. I understand that volunteering may also include assisting in adoptions of rescue dogs at
various pet stores. I understand that the pet stores are not responsible for any illness or
injury caused by an animal that I come into contact with during my volunteer work. I
agree to hold harmless and release from liability the Rescue and the pet stores should I
become sick or injured from any animals as a result of my volunteer work.
3. I understand that the Rescue cannot guarantee or be held responsible for the health,
behaviour, or temperament of any rescue dog I may handle. I am aware that rescue
dogs may cause personal or property damage and agree to keep any dog in foster care
4. I will remember that in all my dealings with the public as a volunteer, I am representing
the Rescue, and that the public will consider my words and actions regarding rescue
activities representative of the attitude and position of the Rescue as an organization. If I
enter activities of a political or controversial nature, I am doing so as an individual,
separate from the Rescue, and these activities should not occur at any of the Rescue’s
5. I understand that as an individual, I cannot enter into agreements for the Rescue; any
such activity will be forwarded to the Rescue’s Board of Directors.
6. I will always remember that I represent a non-profit organization and cannot profit from
any activity related to the Rescue.
7. I understand that I must have prior approval from an Officer of the Rescue’s Board of
Directors, as well as the necessary documentation and receipts, in order to be
reimbursed for expenses.
8. I grant and convey to the Rescue all right, title, and interests in any and all photographs,
images, video, or audio recordings of me, my likeness, or my voice made by the Rescue
in connection with my volunteering for the Rescue.
9. I understand that the Rescue reserves the right to terminate any participant or volunteer
from volunteering with the Rescue at any time for any reason.
10. I expressly agree that this Volunteer Waiver is intended to be as broad and inclusive as
permitted by the laws of the Province of Saskatchewan and that this Volunteer Waiver
shall be governed by and interpreted in accordance with the laws of the Province of
Saskatchewan. I agree that in the event that any clause or provision of this Volunteer
Waiver is deemed invalid, the enforceability of the remaining provisions of this Volunteer
Waiver shall not be affected.
11. I understand this Volunteer Waiver is binding upon me and my successors, assigns,
heirs, executors, administrators, and personal representatives.
12. I attest that I have read this Volunteer Waiver and the statements and information in this
Volunteer Waiver are accurate to the best of my knowledge. I understand by signing
below I agree to the policies as set forth in this Volunteer Waiver.
NOW THEREFORE, FOR THE GOOD AND VALUABLE CONSIDERATION HEREIN DESCRIBED, THE RECEIPT AND SUFFICIENCY OF WHICH ARE HEREBY ACKNOWLEDGED, THE PARTIES AGREE AS FOLLOWS:
1. CARE OF THE FOSTER DOG
1.1 The Foster Home agrees that the well-being of the Foster Dog, while in the Foster Home’s care, is the Foster Home’s responsibility. The Foster Home agrees to comply with all acts and regulations related to care and control of animals.
1.2 The Foster Home agrees to keep the Foster Dog in his or her personal possession and to provide sufficient food, water, shelter, grooming, exercise, and humane treatment to the Foster Dog at all times.
1.3 The Foster Home agrees to provide adequate living conditions for the Foster Dog and that the premises where the Foster Dog is kept may be visited by the Rescue’s Coordinators at any time.
1.4 The Foster Home acknowledges that he or she is responsible for transporting the Foster Dog to and from the approved veterinary clinics for medical treatments. If the Foster Home is unable to transport the Foster Dog, the Foster Home is
responsible for contacting the Rescue to see if another foster home or coordinator may be able to transport the Foster Dog.
1.5 The Foster Home acknowledges that he or she is responsible for attending adoption events with the Foster Dog and providing updated and accurate
information and photos to the Rescue. If the Foster Home is unable to attend an adoption event with the Foster Dog, the Foster Home is responsible for contacting the Rescue to see if another volunteer or coordinator may be able to transport and/or attend the event with the Foster Dog as needed.
1.6 The Foster Home agrees that he or she will not abandon, give, sell, or transfer the Foster Dog to another person (including another foster home), shelter, or rescue without the express permission of the Rescue’s Directors.
1.7 The Foster Home agrees that the Foster Home will not permit the Foster Dog to leave the location of the Foster Home for an extended stay without approval of the Rescue’s Board.
1.8 The Foster Home agrees that he or she will not permit the Foster Dog to be left unattended (in a kennel or otherwise) for more than twelve (12) hours at any given time. If the Foster Home is unable to tend to the Foster Dog within a twelve (12) hour time frame, other arrangements must be made by the Foster Home so that the Foster Dog is attended to during the Foster Home’s absence. Fosters with puppies under 6 months old should attend to them ever four to eight (4-8) hour time frame depending on age, feeding needs, and if in a kennel or pen.
1.9 The Foster Home understands that the Foster Dog is not to run at large except in designated “off leash” areas and the Foster Dog will always be under direct supervision. If the Foster Dog gets loose or runs away, the Foster Home agrees
to contact the Rescue’s Coordinators and Animal Control immediately.
1.10 The Foster Home agrees to make his or her best efforts to engage in training with the Foster Dog including crate training, potty training, training the Foster Dog to not jump up to greet, and training the Foster Dog to sit.
1.11 The Foster Home agrees to attend an obedience class (with or without the Foster Dog) if the Rescue finds that such action is necessary while the Foster Dog is in the care of the Foster Home.
1.12 The Foster Home understands that punishment and force-based training techniques are not to be used with the Foster Dog.
2. Medical and Temperament
2.1 The Foster Home understands that there is no guarantee, warranty, or full knowledge of the Fosters Dog’s health and/or temperament. The Foster Home accepts the Foster Dog into his or her care and agrees to release the Rescue and/or any of its representatives from any and all liability or responsibility in connection with any dogs(s) fostered.
2.2 On intake of the Foster Dog, the Rescue will inform the Foster Home about when
the Foster Dog is required to go in for shots, spaying or neutering, or any additional veterinary care.
2.3 In the event of an emergency, the Foster Home agrees to contact the Rescue’s Director of Intake and Medical or the Rescue’s Director of Fosters. Contact information for these positions is listed in the Foster Guide and located on the
BEDR Foster Foster Homes Facebook page.
2.4 The Foster Home understands that the Rescue will pay for medical expenses and that donated food will be provided by the Rescue. The Foster Home understands that, if deemed necessary, the Rescue will pay for an obedience class as long as
sufficient resources are available. The Foster Home understands that he or she must obtain approval for any expenses prior to any spending.
2.5 The Foster Home agrees to inform the Rescue’s Director of Intake and Medical of any health problems with the Foster Dog or any behavioral issues that occur with the Foster Dog as soon as possible.
2.6 The Foster Home agrees that he or she will not hide any information about the Foster Dog and its temperament from potential adopters or from the Rescue’s Coordinators.
2.7 In the event the Foster Home ceases to be a foster home with the Rescue, the Foster Home agrees to return any items borrowed from the Rescue, including but not limited to crates, toys, and leashes.
2.8 The Foster Home understands that that any monies collected or received on behalf of the Rescue will be turned over to the Rescue’s Treasurer as soon as possible.
3. Removal or Adoption of Foster Dog
3.1 The Foster Home acknowledges that the Rescue is the owner of the Foster Dog until the time the Foster Dog is adopted. The Rescue reserves the right to remove the Foster Dog from the Foster Home at any time.
3.2 Subject to Clause 3.3, the Foster Home agrees to act as a contact for any potential adopters of the Foster Dog to answer any questions the potential adopters may have about the Foster Dog.
3.3 Notwithstanding Clause 3.2, where there are special circumstances present that affect the Foster Home’s ability to act as a contact for potential adopters, answer questions about the Foster Dog, or complete home visits prior to adoption (e.g., conflicts of interest arising out of occupations, etc.), the Foster Home must notify
the Rescue as soon as possible and work with the Rescue to ensure these tasks are assumed by another volunteer or coordinator.
3.4 The Foster Home understands that if he or she wishes to adopt the Foster Dog, the Foster Home must contact the Rescue’s Director of Adoptions as soon as possible and let him or her know of the Foster Home’s interest in adopting the Foster Dog. If the Foster Dog has already been posted to the Rescue’s website for preview of adoption, the Foster Home will be in competition with general public to be selected as the adopter of the Foster Dog. The Foster Home understands that he or she cannot adopt the Foster Dog once other potential adopters are involved in the adoption process (such as when phone calls or emails are sent about the Foster Dog, the potential adopters are meeting the Foster Dog, etc.). The Foster Home understands that, regardless of whether the Foster Home is permitted to adopt the Foster Dog before the Foster Dog is posted on the website or whether the Foster Dog must apply along with the general public to adopt the Foster Dog, an adoption fee will be applied and the Foster Home must fill out an Adoption Application (located on the Rescue’s website) and sign an Adoption Contract with the Rescue to ensure transparency of all adoptions.
4. Actions of the Foster Home
4.1 The Foster Home will conduct himself or herself in a manner that does not discredit the reputation of the Rescue in the community or raise doubts about the integrity of the Rescue or its volunteers, including but not limited to posting on social media.
4.2 The Foster Home understands that under no circumstances shall he or she adopt or guarantee adoption of a Foster Dog without consent from the Rescue’s Director of Adoptions or other appropriate Rescue Board member. The Rescue
retains full rights to approve or deny adoptive homes and retains final say as to whom the Foster Dog is adopted to.
4.3 The Foster Home agrees that all the information in the Foster Home Application
(located on the Rescue’s website) and this Foster Home Contract is true and complete.
4.4 In the event that the Foster Home has selected the option to foster a variety of foster dogs at various times and the Foster Home subsequently wishes to cease acting as a Foster Home, the Foster Home may indicate in writing to the Rescue that he or she wishes to cease acting as a Foster Home. If the Foster Home does not have a Foster Dog in his or her possession at the time the Rescue receives such written notice from
the Foster Home, this Foster Home Contract will be terminated upon receipt of such notice. If the Foster Home has a Foster Dog in his or her possession at the time the Rescue receives such written notice from the Foster Home, the Rescue
and the Foster Home will work together to ensure the Foster Dog is either returned to the Foster Home or, with the approval of the Rescue’s Board, moved to an alternate foster home as soon as reasonably possible. Under these circumstances, once the Foster Home is no longer in possession of a foster dog belonging to the Rescue, this Foster Home Contract will be terminated.
5.1 The Foster Home does not hold liable the Rescue and/or any of its representatives for any actions of the Foster Dog including destructive,
aggressive, or dangerous behavior or for any other problems that may arise pursuant to its foster care.
5.2 The parties, and each of their agents, administrators, executors, assigns, employees, directors, officers, successors, affiliates, and any person claiming through or under them, for good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged, do hereby release, remise, and forever discharge the other parties, employees, directors, officers, associates, administrators, executives, successors, heirs, assigns, personal and legal
representatives, estate trustees, as well as any affiliated companies or related persons from any and all manner of actions, causes of action, suits, proceedings, covenants, contracts, warranties, guarantees, promises, representations, claims, demands, complaints, damages, loss of profit, expense, loss of reputation, loss of business, costs, expenses, sums of money, interest, or injury and liability whatsoever, both in law and equity, whether implied or expressed, which each party has, has had, or may hereafter have with respect to all matters, claims, demands, causes of action, where now existing or hereafter arising, except with respect to covenants arising under this Foster Home Contract.
6.1 This Foster Home Contract shall be binding upon and shall inure to the benefit of each of the parties hereto and their respective current and former employees, directors, officers, associates, administrators, executors, successors, heirs,
assigns, and legal representatives.
6.2 This Foster Home Contract contains the entire agreement and understanding between the parties. There are no oral understandings, terms, or conditions and neither party has relied upon any representation, express or implied, not contained in this Foster Home Contract.
6.3 Except as herein otherwise provided, no subsequent alteration, amendment, change or addition to this Foster Home Contract will be binding upon the parties hereto unless reduced in writing and signed by the parties.
6.4 No waiver of any provisions of this Foster Home Contract will constitute a waiver of any other provision (whether or not similar), nor will any waiver constitute a continuing waiver unless otherwise expressly agreed to in writing by the parties.
6.5 Any term in this Foster Home Contract which is unenforceable or illegal shall be severed from this Foster Home Contract and shall not affect the enforceability of other terms of this Foster Home Contract.
6.6 The Foster Home will not assign its rights, duties, and obligations under this Foster Home Contract without the prior written consent of the Rescue.
6.7 The parties will execute and deliver all such further documents, do or cause to be done all such further acts and things, and give all such further assurances as may be necessary to give full effect to the provisions and intent of this Foster Home
6.8 This Foster Home Contract shall be exclusively governed by and construed in accordance with the laws of Saskatchewan. The parties agree that all disputes under this Foster Home Contract shall take place in the Courts of Saskatchewan.
6.9 The parties agree to notify each other of any change of address and/or phone number as soon as reasonably practicable.
6.10 The recitals above shall form part of this Foster Home Contract.
