In exchange for being allowed to volunteer for the Rescue, I hereby agree to abide by the following policies during the time I am volunteering for the Rescue:1. I understand it is my decision to volunteer for the Rescue and I will not hold the Rescue, nor any of its members (including without limitation, employees, officers, and directors), successors, and assigns liable for any and all liability, claims, causes of action, costs, damage, injury, or harm caused, arising from, relating to, or which may, or may at any time hereafter, be attributable, directly or indirectly, to my participation in volunteer activities with the Rescue. If the Foster Home is unable to tend to the Foster Dog within a twelve (12) hour time frame, other arrangements must be made by the Foster Home so that the Foster Dog is attended to during the Foster Home’s absence. Fosters with puppies under 6 months old should attend to them ever four to eight (4-8) hour time frame depending on age, feeding needs, and if in a kennel or pen. 1.9 The Foster Home understands that the Foster Dog is not to run at large except in designated “off leash” areas and the Foster Dog will always be under direct supervision. If the Foster Dog gets loose or runs away, the Foster Home agrees to contact the Rescue’s Coordinators and Animal Control immediately. 1.10 The Foster Home agrees to make his or her best efforts to engage in training with the Foster Dog including crate training, potty training, training the Foster Dog to not jump up to greet, and training the Foster Dog to sit. 1.11 The Foster Home agrees to attend an obedience class (with or without the Foster Dog) if the Rescue finds that such action is necessary while the Foster Dog is in the care of the Foster Home. 1.12 The Foster Home understands that punishment and force-based training techniques are not to be used with the Foster Dog.2. Contact information for these positions is listed in the Foster Guide and located on the BEDR Foster Foster Homes Facebook page. 2.4 The Foster Home understands that the Rescue will pay for medical expenses and that donated food will be provided by the Rescue. The Foster Home understands that he or she must obtain approval for any expenses prior to any spending. 2.5 The Foster Home agrees to inform the Rescue’s Director of Intake and Medical of any health problems with the Foster Dog or any behavioral issues that occur with the Foster Dog as soon as possible. 2.6 The Foster Home agrees that he or she will not hide any information about the Foster Dog and its temperament from potential adopters or from the Rescue’s Coordinators. 2.7 In the event the Foster Home ceases to be a foster home with the Rescue, the Foster Home agrees to return any items borrowed from the Rescue, including but not limited to crates, toys, and leashes. 2.8 The Foster Home understands that that any monies collected or received on behalf of the Rescue will be turned over to the Rescue’s Treasurer as soon as possible. 3. The Rescue reserves the right to remove the Foster Dog from the Foster Home at any time. 3.2 Subject to Clause 3.3, the Foster Home agrees to act as a contact for any potential adopters of the Foster Dog to answer any questions the potential adopters may have about the Foster Dog. 3.3 Notwithstanding Clause 3.2, where there are special circumstances present that affect the Foster Home’s ability to act as a contact for potential adopters, answer questions about the Foster Dog, or complete home visits prior to adoption (e.g., conflicts of interest arising out of occupations, etc.), the Foster Home must notify the Rescue as soon as possible and work with the Rescue to ensure these tasks are assumed by another volunteer or coordinator. 3.4 The Foster Home understands that if he or she wishes to adopt the Foster Dog, the Foster Home must contact the Rescue’s Director of Adoptions as soon as possible and let him or her know of the Foster Home’s interest in adopting the Foster Dog. If the Foster Dog has already been posted to the Rescue’s website for preview of adoption, the Foster Home will be in competition with general public to be selected as the adopter of the Foster Dog. The Foster Home understands that he or she cannot adopt the Foster Dog once other potential adopters are involved in the adoption process (such as when phone calls or emails are sent about the Foster Dog, the potential adopters are meeting the Foster Dog, etc.). The Foster Home understands that, regardless of whether the Foster Home is permitted to adopt the Foster Dog before the Foster Dog is posted on the website or whether the Foster Dog must apply along with the general public to adopt the Foster Dog, an adoption fee will be applied and the Foster Home must fill out an Adoption Application (located on the Rescue’s website) and sign an Adoption Contract with the Rescue to ensure transparency of all adoptions.4. Actions of the Foster Home 4.1 The Foster Home will conduct himself or herself in a manner that does not discredit the reputation of the Rescue in the community or raise doubts about the integrity of the Rescue or its volunteers, including but not limited to posting on social media. 4.2 The Foster Home understands that under no circumstances shall he or she adopt or guarantee adoption of a Foster Dog without consent from the Rescue’s Director of Adoptions or other appropriate Rescue Board member. The Rescue retains full rights to approve or deny adoptive homes and retains final say as to whom the Foster Dog is adopted to. 4.3 The Foster Home agrees that all the information in the Foster Home Application (located on the Rescue’s website) and this Foster Home Contract is true and complete. 4.4 In the event that the Foster Home has selected the option to foster a variety of foster dogs at various times and the Foster Home subsequently wishes to cease acting as a Foster Home, the Foster Home may indicate in writing to the Rescue that he or she wishes to cease acting as a Foster Home. If the Foster Home does not have a Foster Dog in his or her possession at the time the Rescue receives such written notice from the Foster Home, this Foster Home Contract will be terminated upon receipt of such notice. If the Foster Home has a Foster Dog in his or her possession at the time the Rescue receives such written notice from the Foster Home, the Rescue and the Foster Home will work together to ensure the Foster Dog is either returned to the Foster Home or, with the approval of the Rescue’s Board, moved to an alternate foster home as soon as reasonably possible. Under these circumstances, once the Foster Home is no longer in possession of a foster dog belonging to the Rescue, this Foster Home Contract will be terminated.5. Indemnification 5.1 The Foster Home does not hold liable the Rescue and/or any of its representatives for any actions of the Foster Dog including destructive, aggressive, or dangerous behavior or for any other problems that may arise pursuant to its foster care. 5.2 The parties, and each of their agents, administrators, executors, assigns, employees, directors, officers, successors, affiliates, and any person claiming through or under them, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, do hereby release, remise, and forever discharge the other parties, employees, directors, officers, associates, administrators, executives, successors, heirs, assigns, personal and legal representatives, estate trustees, as well as any affiliated companies or related persons from any and all manner of actions, causes of action, suits, proceedings, covenants, contracts, warranties, guarantees, promises, representations, claims, demands, complaints, damages, loss of profit, expense, loss of reputation, loss of business, costs, expenses, sums of money, interest, or injury and liability whatsoever, both in law and equity, whether implied or expressed, which each party has, has had, or may hereafter have with respect to all matters, claims, demands, causes of action, where now existing or hereafter arising, except with respect to covenants arising under this Foster Home Contract.6.
